emember from last week that English Village Resorts, LLC, a Phoenix-based investment group, was the high bidder on a large portion of the English Village during a private auction Sept. 2, placing a final bid of $4.1 million to beat out three other bidders for 6.5 acres of village property just north of the London Bridge. (This was part of the Epic Resorts bankruptcy proceedings) London Bridge Resort owner (former Epic Resorts owner) Tom Flatley had until the end of business Sept. 5 to match that bid. Long story short, he did.

In the end, Flatley was required by the court to sign the agreement on Tuesday, Sept. 9, and put up a 10% deposit. He did both. He has to close by 5:00pm on Sept 19th or he loses out. He is doing the deal through LB Int'l Holdings, LLC., a company that he is part of.

  • Sept. 13: --" How can Tom Flatley sleep at night, here he can go and use all of our money (all the employees that are owed thousands of dollars) to buy back Lake Havasu? How can this be entirely legal. How much will he have to pay his employees to trust him again?"
  • Sept. 14: --" Flatley still employs hundreds of people with his existing companies. He always has. Everyone knows that Epic went out of business because they lost their timeshare financing. Even though Flatley took a major financial hit by losing Epic he never stopped providing jobs for others. He is a good man and a good employer."
  • Sept. 15: --" Wow, Flatley was a great man (?) What planet are you from and how much were you paid to say that? As an Epic shutout, I am still out a month's pay. I could use some of that money that he paid for the property. And, when I was with Epic, preparing contracts, I had the occasion to refund payments within the recision time . Just before the BK, I was told that they couldn't refund monies because " there was no money in escrow." Holy cow, that's what ESCROW is all about. Guess escrow is in the pocket of the beholder! Yep, great man..."
  • AND: --" Tom Flatley sleeps great at night in his $5000 bed. It should not surprise anyone (I've known him for fifteen years), it always has been, and always will be, all about Tom Flatley. Let us never forget."
  • AND: --" How ironic will it be, if Flatley bids on Epic Resorts in the upcoming Auction and wins the bid? He could end up buying them back for just over 25mil which is about 5 times less than he paid just 5 years ago. Who would work for this man? Who would sell for this man? What vendor would do business with him?"
  • AND: --" I want to write in defense of Todd Lynch. I had the pleasure of working for Mr. Lynch from 1996 to 1998 on several occasions. He was always willing to help me out when I was in need. He went way beyond the call of " employer duty" by personally lending me a few $'s to get by when I was struggling, or even a hotel room if I didn't have a place to stay if that was what was needed. His enthusiasm during his Sunday morning sales meetings was worth showing up for in itself. I was very saddened to hear about the downfall and eventual demise of Epic Resorts. I know it was not for lack of enthusiasm, desire or the love of what he was doing. You could tell be the look in his eyes and in the tone of his voice he would succeed. In this endeavor he may not have succeeded, and I am sure he learned a very important lesson. But if anyone can and will recover from the past, it will be Todd Lynch!

  • September 16: --" Todd Lynch a good man??? Please, he took all his money he got out of Epic and opened all of his TSN stores at the old Epic sales sites, Minnesota, Detroit, Chicago, Baltimore just to name a few. Where did he get all his money from? I am sure all the people (rumor has it) that went to work for him that were former Epic employees received their back income. What happens to the rest of us. We'll be lucky to see a dime. Anyone that will work for them in the future should have their head examined. Why couldn't these sites have been sold and all of us paid even $.50 on the dollar. Lives were ruined, people's credit destroyed, divorces, but who is to blame-- I know, all the Epic Head Honchos-- you know who you are!!!!"
  • AND: --" I could not help but LAUGH OUT LOUD! The last writer on the London Bridge/Lake Havasu issue is writing in defense of Todd Lynch. I read the entire article and never saw Todd Lynch's name mentioned one time. Although everyone knows that Todd is Tom Flatley's puppet and runs the Travel Club sales rooms for him. The rumors are that Flatley wants to buy the property in Lake Havasu to build another Timeshare Resort. They are bragging on how they are going to start another TS company, (Flatley/ Lynch/ Knight/ Stucki), although they are very happy with Travel Club sales, since they do not have a product cost. Todd is promising all the Fools that fall for his BS that when the new company gets started they will be given high paying positions. Stay tuned! The EPIC saga will continue."
  • AND: --" If the four musketeers are planning a new timeshare resort in the Englist village, they will have a battle with Lake Havasu City. None of the city officals wanted Flatley to get the English village back and would make it very difficult for Flatley to get it done. Knowing Flatley he will find a way to get it done. He always has a great story to tell to any suckers willing to listen."
  • Sept. 17: --" Kudos to the Beat for letting us all vent our anger on Epic and Tom Flatley. I am sure there are lots of heartless business folks out there, he is just the one who caused a lot of damage to the timeshare sales and work force. I personally believe in the " universal order and justice of things" He will get the " comes around" due to him. To the new recruits he will acquire, " be careful" , get one of those wallets with the chain attached. Just an ole timer's opinion, I could be wrong."
  • AND: --" It is a fact that most of us were paid all of our commissions and even bonuses that were owed us from EPIC if we stayed with the Travel Club sales (TSN) when EPIC went bust. I know for sure, I was one of them and have copies of all the checks (5 Star Management) to prove it. ... These guys think that they are going to slide under the Radar and start up again, just because they have money. They are in for a big surprise. We shall never forget! Thank you, The Beat. We may not be able to stop these scoundrels from opening up another shop, but we sure can expose them and let the public know what the truth is!"
  • AND: --" Todd Lynch has always been a small time operator. He tried to hide behind his vacation stores but has been run out of every state he has operated in. No one will work for him except those who have been fired every place else. It will be interesting to see what Lynch tries to do next."

PEORIA: The Arizona Cardinals and Princeton Resorts Group have entered into an advertising and promotional relationship between the team and the under construction Cibola Vista Resort and Spa in northern Peoria at Lake Pleasant. The agreement provides for joint marketing and customer relations, and includes use of resort accommodations and meeting facilities by the Cardinals. Construction began last month on the 63,000-seat multipurpose stadium near the Loop 101 and Maryland Avenue in Glendale, just south of Peoria. The stadium is scheduled to open in 2006. CALIFORNIA:
PALM SPRINGS: The Cabazon Band of Mission Indians' continuing expansion of its Fantasy Springs Resort near Indio, with construction well underway, includes plans for a 150-unit timeshare complex built throughout the championship golf course greens. Questions: 1) Will this be the first timeshare resort to actually open at an Indian casino project? and 2) Who will do the timeshare part?

  • Sept. 12: --" Looks like that area will become a major timeshare area, with Trendwest developing 455 timeshare units at Landmark Golf Resort which is only a few blocks away."
  • Sept. 13: --" An even more interesting question that needs answered will be regulation and who the land belongs to. The tribe can't just sell trust land, so a deed & title project seems unlikely, unless done off reservation. Watch out -right to use is coming to CA! I don't know where the boundaries of the reservation are, though, so this may yet work out.

    But even more important is questions of tribal sovereignty - the tribe cannot be sued without their own consent. I cannot imagine the state giving authorization to a tribal project on non-reservation land without them agreeing to waive sovereignty. On tribal land, the state would have no say whatsoever, of course. Could you imagine someone trying to cancel and the tribe saying " Gee, sorry, we don't feel like giving your money back?"
  • AND: --" Timeshare on tribal land is not new to California, or the Palm Springs area. Lawrence Welk's Desert Oasis in Cathedral City is a tribal leasehold. It sold well, and it re-sells just fine. Not a bad model to follow for a lease construct.

COLORADO:
Are you ready for some skiing? Local skiers and snowboarders rejoiced when they woke up in the morning of Sept. 9 to see fresh powder blanketing the peaks of Breckenridge. Resort officials measured between one and three inches of snow overnight on the resort's peaks. The unseasonable storm also blanketed the San Juan and La Plata mountains with snow, bringing at least 10 inches to Molas Pass and 4 inches to Silverton and at the top of the mountain at Durango Mountain Resort, with more expected. Happy skiers are already calling seeking season passes.

VAIL: Spotted at the recent Vail Wine & Food Festival at the Ritz-Carlton in Bachelor Gulch was retired Coors Beer wholesale distributor from Columbia, Mo., Bill Woodward, with his wife, Mary Ann, who is the sales and marketing director for the Ritz-Carlton Club. The club's project director, Jeff Meier, was sharing a few laughs with Rich Knapp, general manager of Vail Valley Community Television Channel 5. And a good time was had by all, in spite of the uncooperative weather.

HAWAII:
MAUI: Until now there has not been a purpose-built, large, beachfront project on Maui that was designed as a timeshare from the concept stage. Starwood's Westin Kaanapali Ocean Resort Villas is the first, and it is far enough along to have had its certificate-of-occupancy inspections, although it will not open for business until Sept. 24.

Phase one of 103 units is nearly sold out, at the highest prices ever commanded by a timeshare project in the islands. Offering prices were raised shortly after sales began a year ago and Westin realized how much demand there was. Prices for a week for a two-bedroom run from something over $20,000 to nearly $50,000.

Sales have been so fast that construction of the second and third phases has been advanced, although general manager Gregg Lundberg says the resort will not be completed until the first quarter of 2005.

After that, Starwood projects another resort next door at North Beach. The exact future of the whole of North Beach is uncertain, but it looks as if it will be all or nearly all timeshare. Intrawest has purchased one lot and taken an option on another at North Beach, although it has not announced what it plans to do with the land. Will they build a village? Will they offer fractional and/or timeshare?

KAUAI: Kudos are in order: --" Greg Mincin proved once again why he is considered by many as the best in Hawaii. He had a net close of 35% for the last 60 days, made 50k, worked 3 days a week 4 hours a day in the developer suite at the Banyan Harbor Resort on Kauai. Way to go " Munchy" and thanks to Herb Lee and the in house opc's for sending great tours. ~ Ben Bregman Developer"

NEVADA:
LAS VEGAS: Regarding Leisure Industries and the Cimarron Resort in Cathedral City, CA: Leisure's deal to become the developer of the build out at Cimarron Resort (200 additional suites on the undeveloped land) fell through. They were unable to secure the deal with the Developer/Owner of the land, Royal Mirage, and the management company of the existing 40 suites, Raintree. That is why you see no reference to the resort in the company's assets list.

The reference to the golf course in their recent press release (Corporate Assets of Leisure Industries Corp. to be Liquidated ) is the Cimarron Golf Club. Leisure is the owner of the Cimarron Golf Club and the Leapin Lizard Restaurant located at the Cimarron Resort. The 3 entities are separately owned businesses.

  • Sept. 12: --" Could Cimarron Resort be a diamond in the rough for who ever takes it over? Its golf course backs up to Doral Desert Princess Resort and the new proposed Palm Springs Classic luxury resort development including a 4 or 5 star hotel with timeshare and luxury housing on a new 18 hole golf course..."
  • AND: --" Cimarron - Diamond in the rough? or a pasty Catherdral City slum? A little of both, but probably neither. Coachella Valley is filling up with projects - old, new and proposed. Everyone comes looking at the OPC potential in PS. Like Cimarron's original developer, it's a royale " mirage" . The desert is a minivac market competing with everyone within 300 miles for the SOCAL weekenders in season from November to April, and competing with SOCAL beaches, movies and theme parks for attention the rest of the year. Like Intrawest in Palm Desert, the summer can close you down, at least for the summer, if not forever. Cimarron needs to get annexed by Palm Springs, cut a long term deal with one of the local hoteliers, build an FIT hotel on property to support minivacs and an " on-site" program to succeed. Even though the golf at Cimarron is superb, few are those who want their desert golf to be exclusively " treeless" . If you can bring 'em in from the coast year-round, have a place to put them and some broader golf options in your product someone could make a sheckle or two out of it... as long as they don't think it's going to command Marriott or Starwood prices."
  • AND: --" Well maybe Marriott and Starwood have to rely on bringing mini vac tours to the Coachella Valley because they have not been able to establish mass offsite sales locations that could bring the product to people instead of the high priced people to the product method. Plus, to have a resort that is relatively new with permits for expansion is something that doesn't come along every day. And who knows what the next years will bring with new telemarketing rules going into affect on setting those mini vacs also."

AND: Rumor has it that the Lady Luck is now fully up and operational as a half timeshare and half hotel. Tours are coming through. A potential problem that is keeping eyeballs on the venture is that managing company Steadfast has never done this before. You know how nervous newbie companies can get because they don't understand the whole process. It can be dangerous to a start-up, which always has kinks to iron out anyway.

AND: Consolidated Resorts' Club de Soleil reportedly took the " cream of the crop" from rooms 1 & 2 and moved them to the new Tahiti Resort on West Tropicana, which opened the weekend of the 6th/7th. Not all reps and T.O.s are happy: Word is the podium king is a " heat merchant" . Yes? No?

  • Sept. 12: --" Consolidated is coming up with some neat marketing ideas. I was listening to ESPN radio today and they were interviewing Al Bernstein, the fight guru and announcer, about this Saturday's fight between De La Hoya and Moseley. Next thing you know, in mid interview, he let's us know that you can come in and stay 4 days and 3 nights with Consolidated for free so call 800... Then I almost choked on my coffee from laughter when he ended with " now this is designed specifically for couples, so you can make it like a second honeymoon" .. right on the radio! Who says you need telemarketing!"
  • Sept. 16: --" It seems the " Angel of Death" has given a farewell kiss to some longtime rep's. Rumor is it will be giving the farewell kiss to more of them by the end of the month. So much for all the years of service and the loyalty shown by them."

MINDEN: John Serpa's proposed golf course development above Clear Creek (near Carson City in northwest Nevada) has gotten his rezoning request approved finally. He was looking for a transfer of density from Carson Valley to the property, which would allow them to develop 241 one-acre lots, 136 8,000-square-foot lots, 221 acres for a golf course and 18 timeshare/guest lodges. The remaining 865 acres would be open space. In mid-August the Douglas County planning commission recommended denial of this project, with residents and the Washoe Tribe voicing strong opposition to it. At the recent Commission meeting Project Manager Greg Haws showed several before-and-after doctored photos he said proves the development will be barely visible from Carson Valley, and the Commission gave him the OK.

The project site is bounded by U.S. Forest Service federal public lands, property owned by the Washoe Tribe, private owners and Douglas County. It is a half-mile north of Jacks Valley Road and south of Old Clear Creek Road, west of Highway 395.

AND: Intergroup Realty has closed the sale of the second of two phases of 8.29 acres of land within The Parkway, Intergroup’s 195-acre mixed-use development adjacent to Walt Disney World and Disney's new city Celebration. In a prepared statement, Intergroup Realty Inc. says it plans to work with " one of the largest private timeshare developers in the Unites States" to develop a 336-unit, mid-rise on 14 acres.

When completed, the project will join some 1,000 existing hotel rooms, several hundred existing timeshare units, extensive commercial space, multi-family units, and a large dinner theater within The Parkway.

There are not that many major " private" timeshare developers in the USA. Westgate is the biggest, of course, then there are Shell Vacations, Berkley Group... Who else is " big" ? Could Intergroup's unwillingness to name the developer mean that they don't actually have a contract? Shell needs to be in Orlando... What do you think?

  • Sept. 12: --" Intergroup and Berkely are in bed together on Parkway. Berkley recently aquired the Regency group which owned 6 resorts on the Pinellas county beaches. Berkley is now setting up an offsite office to sell Parkway to Regency owners and Pinellas county tourist and residents... and the beat goes on"

AND: Disney Vacation Club plans to open 192 units of its Saratoga Springs Resort and Spa near Downtown Disney in May 2004. Formerly the Disney Institute, the new resort will have a total of 552 units with the final phase of construction being completed in 2005. It will include a theme pool, playground and barbecue pavilion.

The 184 Vacation Homes/280 Room development will occupy a unique 16-acre site overlooking the lakefront district at the Downtown Disney area. Initial plans call for the construction of four residential-style buildings with studio, one- and two-bedroom villas and Grand Villa units that sleep up to 12 guests. The buildings will be 3 and 4 story residential style.

AND: There are some annoyed owners at Bluetree, people who owned there long before Westgate bought the property. They tell us that Westgate wanted CFI to manage their Bluetree Owners Association but they already had SPM for a management company and didn't think it was a good idea for the developer to also manage the Resort. So Westgate formed its own Owners Association and banned the other one from the developer-controlled areas-- like the formal lobby. To check in, the old owners now have to use a trailer which was placed at the back of the site. The Bluetree Owners Association has also had to rent offices off-site to run the day-to-day activities of the Association. They consider it similar to a hostile takeover. Has Bluetree also lost its 5-Star rating?

AND: Travel Concepts LLC, in Ocoee, which incorporated in Florida in Sept. 2002, was part of a group of holiday clubs based in Europe which was wound up by the High Court early this month following investigation by the UK's DTI. The parent company was The Travellers Guild Limited, and the other 3 were The Travellers' Guild (UK) Limited, Buckingham Leisure Limited, and Riverside Travel Services Limited. Of nearly £2 million that went into the Travellers Guild Limited bank account in Jersey between November 2001 and February 2003, less than £60,000 can be seen to have benefited customers, about half of which was used to maintain their website.

From the spring of 2003 membership of Travel Concepts LLC was being marketed within the USA by Travel Concepts, who operated the website www.conceptravel.com. The website and the Florida corporation are registered to Mark Western. Anyone know that person?

WISCONSIN:
MADISON: The Attorney General for Wisconsin has filed 3 lawsuits against out of state companies that allegedly violated the state's no-call law. Among the complaints:
  • The complaint against P& M Consulting and Marktel II alleges that the defendants have been illegally soliciting the sale of timeshare properties for Bluegreen Corp. and Christmas Mountain Village. There were at least 96 contacts reported.
  • The complaint against Platinum Marketing Group alleges that the company has been illegally soliciting the sale of timeshare properties for Mirror Lake Resort. At least seven contacts were reported.

The companies also allegedly solicited Wisconsin consumers with pre-recorded messages without the customer's consent. P & M and Marktel II had at least 77 and Platinum Marketing had 17 such calls.

In addition, Platinum Marketing Group had not registered as a telemarketer with the state.

The complaints seek injunctive relief halting further violations of Wisconsin law and civil forfeitures for past violations. The companies face penalties of at least $100 per violation.

Rumors Rumors Who's Got the Rumors?
  • Is there any truth to the rumor that sales reps at the Sheraton Desert Oasis are so unhappy with management that Starwood had to offer a bonus for reps just to stay with the company?

    • Sept. 13: --" This is the second bonus given out this year. The total amount is OVER $200,000!! Reps are still leaving anyway. WHY?"
    • AND: --" Maybe they should have given the money to the original management team and there would not have been a problem..."

  • Is there any truth to the rumor that the race for Director of Sales at the Marriott Palm Desert is starting to look like California's Governor's race with around a dozen " egomaniacs" and inexperienced people vying for the position?
  • Is there any truth to the rumor that Starwood has sold the Oak Plantation Resort in Kissimmee? It isn't on their websites any more. If so, who are the buyers? Price? What will happen to the owners who purchased there?

    • AND: --" Starwood also manages Vistana's Beach Club on Hutchinson Island, Fl and it is not listed in their " resort collection" as it is not a branded Sheraton or Westin property."
    • AND: --" I worked at Mission Hills and had asked one of the to's why if we own the above why are they not listed as starwood the ANS was they are not up to par with the rest of the starwood resorts...you know, they do have some spectacular resorts even if only 14."
    • Sept. 14: --" The Street asks a good question ..." What happens to the owners?" Starwood gets to hide its ugly duckling resorts, with a convenient " ain't no kin o' mine" . How expedient. Beats actually having to uphold a standard. They just hide the ones that don't strike the right pose for the cameras. The properties were good enough for a real estate flip, and the owners, well, 'they aint no kin o' mine, neither."
    • Sept. 16: --" Oak Plantation has always been a " Joint Venture" property in conjunction with a second party that originally developed the property. I suspect the real reason Starwood has not added the resort to its growing collection is the simple fact that they don't have complete control of the property as they would if they owned it themselves. Otherwise, a point system like Starwood's could easily incorporate a nice little resort like Oak Plantation by simply offering a lower points value to the weeks there."
    • AND: --" Well Harborside Resort at Atlantis is a joint venture between Sol Kerzner and Starwood and it still shows up on the website of Starwood Vacation Ownership so why wouldn't other joint ventures. Also, will Starwood get the next 120 villas that are under development at Harborside at Atlantis or will Sol Kerzner joint venture with another timeshare operator for those?"
    • Sept. 18: --" Management at Starwood Villages announced that the property is under contract to be sold and that the reps are being transferred to other properties. Money and players were not mentioned but resort staff says that the closing is in October and that the management team will be out by Jan. as to the owners and what happens to them is still unclear. But the fact is it IS being sold as we speak. How about it Starwood execs are you going to let us know what is going on? Time to disclose!!"
    • AND: --" I own a week at Oak. Since it has always been treated like an ugly stepchild by Starwood, I am hopeful that the new developer will be one that has a points program that will include Oak and other benefits that we currently don't enjoy. But to compare Oak with Harborside? I want some of what ever you're smok'n!"

The Orlando/Orange County Convention & Visitors Bureau's most recent figures show that the number of U.S. visitors to the Orlando area rose from 2001 to 2002 by 7.7 percent to 40.6 million, but the number of international tourists fell 22.3 percent to 2.4 million. For the weeks of August 21- Sept. 6 Orlando reported 41.4 percent occupancy. Not good. Is all this affecting anyone's numbers in a significant way?
