This is an intriguing juxtaposition. How often do you hear of one charity donating to another charity? Well, you've got Christel House, which helps orphans and disadvantaged children to have a better life and a future, and you've got Time 4 Sharing, which does a similar thing. Christel House accepts donations of money to help further their efforts Time 4 Sharing accepts only donations of time and effort to further their efforts. Now, Time 4 Sharing has announced a competition to other resorts around the world to offer ideas on how they can organize a magic day for kids in need. The winner will receive $1,000 which Time4Sharing.com will donate to Christel House on their behalf. Details of the competition are on the website. http://www.time4sharing.com Is that a win-win deal or what?! So how creative are you, and how much do you care about kids in need? Make a difference in the world. Small deeds often have enormous impact.

We are are making some progress on details of the new Association for timeshare folks-- and related businesses-- that need insurance benefits at a reasonable price. There have been many good submissions for a name for this new Association, and we want to narrow them down to the top five. Here's where your input comes in, since this will be YOUR Association. Take a look at the choices and email The Beat with the one you like best. We'd do this in poll fashion, but some folks might be tempted to stuff the ballot. Not you, of course, but some folks-- those other folks. So which of these names do YOU think best represents you? Last week we aired this question: --" Aqua Sun has had most of its Board of Directors sign a document allowing them to pay their own maintenance fees and taxes over a period of 12 months, yet each owner must pay when due, according to the Director of Operations. She said she has a CAM license and it is legal. How is that legal in a turned over resort? Why doesn't the timeshare governing authority do something about it? If I want to rent my unit, they tell me I must pay my fees first, but they don't have to. They tell me they can lock me out, but they don't lock themselves out or pay a lockout fee. Why not? Do all developers work this way? Who can look into this?" We aired a response or two, and then this one came in, just a bit late to add to the mix. So we're posting it this week to make sure anyone interested in the subject gets the chance to read it.

  • " As one of the Directors mentioned in the Aqua Sun article, I can say that I was not asked to sign any document regarding fabricated time sheets to offset fees that were owed to these various associations. If any Board member has a question, since the associations actually pay for the audit, they could simply ask if the fees were paid in full by cash or a journal entry, and when they were paid. If it was a journal entry, any support should be made available to them from the auditor. Something that would concern me is the fact that since the Board has a legitimate obligation and fiduciary responsibility to the association, and in essence they hire the management company, they are ultimately responsible and could be held liable. ...In reading the articles [about Aqua Sun] so far, all I have read are true... The saddest thing of all is that they still don't seem to care, and that only hurts the industry."

Sunterra: The Cypress Pointe Resort at Lake Buena Vista Condominium Association and its Board of Directors were sued in Federal District Court by Sunterra Corporation in an attempt to stop the Association efforts to terminate RPM Management, a wholly owned subsidiary of Sunterra Corporation. Citing the ongoing management problems at the resort since being turned over to owner control, the Association has worked since prior to expiration of the management agreement December 31, 2000 to remove RPM as the resort management. RPM has resisted those actions and has now taken to the courts to remain at Cypress Pointe. Read about it here.

How long before Andy Gennuso gets Sunterra up and runnng at full steam in Florida, Virginia, Arizona and Hawaii? Is Sunterra Pacific really for sale? Sales people have been watching and waiting for the return of this entrepreneurial company and a place to call home. What type of power shift will it create in the industry, and who will be the winners and losers?

Meanwhile, has anyone had any success yet getting their reserve funds back from the company? Seems like lots of people are still waiting, and wondering what steps they should be taking.

As of Wednesday night four more sales agents have walked out on the management at Shell's Orange Tree Golf Resort in Arizona, or so we hear. Mostly, they say, because of the spiff budget being spent on trips to Cabo and not being given out to the sales staff. Anything to that? Reports are that there are only 6 agents left on the night line and more to leave soon. An agent who had been there for 3 years reportedly quit Wednesday night when a new agent who had not ever sold timeshare was moved in front of him on the rotation, and ahead of all the other agents also. Love line on the night line too, looks like. Not good, if true. Says one annoyed person, " Before long there will not be an Orange Tree Golf Resort unless Perry S., Shelly G., Simon C. and Joe Malone wake up and come down to Arizona and get things straightened out... I hope you guys print this so maybe something can get done to get Shell back in touch with what's going on before it is too late. There is not one Management (sales) that is respected. Wake Up Northbrook, Il, it's time!!!!!!!!!"

We are sure there is another side of the story, and we'd like to hear it. Whatever is going on there, it looks to The Street that there are a LOT of rebellious sales agents there. Trouble is, there aren't a lot of other places to work in the immediate area. Kind of limits the options, without moving much farther afield.

KUDOS: Lloyd Cowle, a 28-year veteran of the timeshare industry and a long-time member of ARDA, has been working for the last 11 years with Ramada/PEC. He is currently the Senior Sales Manager for Ramada Vacation Suites in-house department in Las Vegas. Well, 28 years in the biz and 11 with the same company is worthy of Kudos all by itself, but there's more. We hear that Lloyd processed $4.6 million last year, his best year ever. And that during April of this year he closed and processed $582,000-- his best month ever. Yikes! and Wow! The Street is impressed.

And, rumor has it that Randy Reeves, the new project director at Epic's Hilton Head Island Links resort, and his staff had the best VPT month ever at the resort in April, and this month they're doing it again. Is this a sign that the property is being run by someone who knows what they're doing?

Looking at the recent news about the Entrada project in lovely Santa Barbara, California, who do you suppose will get the sales contract and management of that resort? Will it be fractional or timeshare? (See Entrada design sees the lite)

We hear that some of the top sales people are leaving Bluegreen's Lodge Alley Inn for new horizons. True? Who's taking over as the new DOS there? And what's the problem? We hear rumors, but would like to know the facts... And what's this about the new bonus structure with Bluegreen that we've been hearing about? Apparently if one writes an upgrade it counts to bonus only when the deal is booked at corporate and they will not tell you when that is until you get paid on it, if ever! " Is this the pits or what?" asks one person, who added: " This may be the final straw with Bluegreen before reps start quitting left and right because they can no longer know where they stand on bonus..."

  • COMMENT from you: --" It's true! here is the chain of events on an upgrade sale.... rep tours, convinces the owner that they need more product than they bought originally (a feat in itself), writes the contract, people sign it, then everyone waits out rescission, and THEN, the deal gets sent to the corporate office.... (remember, this may be the 5th or 6th day after the contract was signed). Once it gets to corporate, there is a process of title searches, mortgage searches, (no one will give a time limit on how long this could take) and finally, after everyone is convinced that it is okay to take this deal, in some cases weeks after the fact, a check is cut to the rep for the base commision, for which he/she will be paid 3 weeks later, and the deal becomes eligible for bonus.... The problem with that is, no one will step up and say when that is, and there is apparently no way to track the progress of a deal once it is written. Sounds to me like this is a convenient way to avoid paying large bonuses to the in-house reps, since a deal written in 1 month may not be good for 2 or 3 months, and the company has the ability of saying when, and the rep has no control, or no recourse. Let's give Bluegreen a hand for another bendover-well-done."
    • NOTE: We are told that John Maloney, who has resigned from ClubCorps, has indeed been brought in to Bluegreen, but not as COO as we previously reported (and which was immediately corrected). Now we hear he is to be Bluegreen's Executive Vice President of Resort Operations, Development and Marketing. Says our source: --" What does it do to David Bidgood and Shawn Erickson? John comes with a great resume and he can back it up! We wish him the best in his challenges!" And so does The Street.

      We'd ask Bluegreen outright, but the last time we asked for clarification/verification on this issue we never received any response, which is the norm, by the way-- and not just with Bluegreen. So much for BG's complaint that we don't ask...

We should note here that some resort companies are very accommodating about responding to our questions and make themselves easy to get in touch with. We like that, naturally, even when they are cagey with their responses.

Word is that Trendwest may soon open an additional office in the South Bay area of Southern California and move its Costa Mesa office to Irvine Spectrum, Orange County's premier dining, shopping and entertainment center. That's a truly hot spot. While we're on the subject, who will be running the new sales line for Trendwest in San Jose Del Cabo, Mexico? Will Trendwest's proposed resort in Windsor, California get approved (See Developer argues for resort hotel near airport)? Or will this be another 'Calistoga' effort for them? And are Epic Resorts, Monarch Grand Vacations and Trendwest setting up an affiliation for internal exchange for their members? (And has Epic been able to get its financing?) Interesting to note that when Trendwest officially joins Interval International on October 1 (See Trendwest Resorts, Inc. Selects Interval International As Exchange Provider) RCI will have very few active affiliate sales sites in California. It will be just Shell with two offices, Fairfield with one resort sales location and Intrawest with one resort sales location. Did we miss any?

Is history repeating itself? It looks like Tempus Resorts has lost yet another Director and their training department is up for grabs again! Word on the street is that they haven't been able to keep anyone in that department longer than 6 months since the Sanchez brothers (Juan and Nestor) left. And where is Tim 'Golden Boy' Craig, the former Director of Training? What's going on? And by the way, what are Juan and Nestor doing these days?

AND here's another thing. If Bass Hotels and Resorts buys Wyndham Hotels and Resorts, will this also trumpet its full entrance into vacation ownership via Wyndham's deal with Tempus?

Word on the Street is that Summer Bay Resort in the Orlando area had a deal very close to being signed to purchase AMBER Vacation Resorts. At the last minute, or so we hear, the two companies could not agree on certain terms and the deal fell through. Anything new on that front? The AMBER Vacation Club (AVC) is comprised of and available exclusively to owners within AMBER Vacation Resorts and its affiliate resorts. Currently, these resorts are:

  • Sunrise Ridge Resort, Pigeon Forge, Tennessee
  • Casa del Mar Beach Resort, Ormond Beach, Florida
  • Alhambra Villas, Kissimmee, Florida
  • Tree Tops Resort, Gatlinburg, Tennessee
  • Oakmont Resort, Pigeon Forge, Tennessee

Where will Summer Bay look next? And who will look at AMBER next?

RCI Points: We sent some specific questions to RCI last week, both so we would not mis-state things and to give them the opportunity to address the issues up front. We finally received their final response on Thursday May 24, and we wish to thank John Barrows, Director of Communications, and Helene Guss, Manager, External Communications, for their assistance.

  • Beat: To begin, NC, SC, FL and HI now have open inquiry files into the nature of the Points program, as we understand it. RCI has brought on either additional or replacement outside counsel (?), Jim Scavo of Atlanta, GA.

    RCI: In the course of introducing a new and different kind of exchange program such as RCI Points, it is natural that questions arise from interested parties including customers, consumers, the media, and even members of various regulatory agencies. RCI has been working closely with the agencies to answer all of their questions, and we believe that all issues will be resolved in the near future. RCI has retained Atlanta attorney Jim Scavo of the firm Weinstock & Scavo as additional outside counsel.

    Beat: Fairfield Communities, Inc., runs its FairShare Plus exchange program on a point system. We are told that currently FS Plus members can access RCI Weeks, but FCI members cannot [access RCI Points] and that talks are underway to modify FS Plus and RCI Points so the FCI members can access RCI Points inventory. Will FS Plus remain a separate program, or will it merge into RCI Points? How will any modifications in the RCI Points program affect other resorts and individual members?

    RCI: All Fairfield owners who own at Fairfield resorts that are affiliated with RCI can currently exchange through RCI Weeks. Owners who are members of FairShare Plus receive a membership in RCI Weeks as part of their membership in FairShare Plus. FairShare Plus will be enhanced to include RCI Points as an optional member benefit. RCI Weeks will continue to be a member benefit of FairShare Plus. Fairfield owners who are not members of FairShare Plus will continue to exchange through RCI Weeks. This is a common arrangement with RCI and affiliates with points-based programs.

    FairShare Plus will remain a separate program for the foreseeable future. Other resorts and individual members will be unaffected by the FairShare Plus upgrade to RCI Points.

    The Beat: Existing purchasers are being solicited to join RCI Points and their cost for joining is reported to be as much as several thousand dollars more than the cost to someone who joins at the time of purchasing a new timeshare interest from a developer. Is it correct that RCI is paid $199 per new member, with the seller of the program receiving the balance of whatever is charged? And if a new timeshare purchaser joins RCI Points at point of sale from a developer, is RCI still paid the same $199 (or whatever the correct amount is)?

    RCI: RCI is solely paid $199 per new member, regardless of whether it is a new purchaser or an existing owner converting to the RCI Points Program. This $199 represents the RCI Points enrollment fee of $100 and first year's membership fee of $99.

God bless 'em, but it took a WEEK to formulate, and sign off on, that last response. Perhaps we worded our question poorly. We have a lot more questions. We'll pose them in a more closerly fashion.

There is a plethora of concerns being expressed both by industry people and consumers on this topic, and the results of our current poll on the subject has been interesting (remember that this poll is not scientific). We think the correct answer to the poll is " It's too early to tell" , but that's just our opinion. We could be wrong.

It will take time to shake it all out. See also a couple of Letters to the Editor for other takes on RCI Points. AND, here's one that might make you chuckle.

    • IN RESPONSE May 25: --" He is a piece of Southern good OLE boy work now. He could not close a door let alone a deal. He is in the House again, not his first time either. He is famous for making the Shag the State Dance, that was done as he held the last seat in the house. Now he has made Beach Music the official SC Music. With talent like that, and a greased palm, this Clemson Alum, TS Sales, Tobbacco farmer is sure to help RCI with GPN. Gotta love the Good OLE boys. By the way the name is Bubber not Bubba be sure to get that right!! :) He also makes a great cucumber sandwich, and his pimento spread is to die for. Y'all be good!"
  • COMMENT from you May 26: --" Your poll on whether or not RCI Points is " good for the consumer" I find to be odd. Clearly what is needed is (as always) education. I feel those who have entered a negative response to your poll are ignorant to the benefits of points, work for II resorts, or live in North/South Carolina. The trends of how existing members are choosing to use their RCI Points speaks volumes."

Just Wondering:

  • Who has the contract for those box programs in Denny's Restaurants we hear about throughout California? What company is this, and who are the main people involved? We hear it is wildly successful and must be making a ton of money for someone-- but who? And who is getting those tours?
  • Who's running the Westgate project in Park City, Utah at The Canyons, we asked? The answer to this one is that Martin Reese is the PD there. Martin previously served as PD at Snowbird, also in Utah, and is the winner of a couple of Silver and Gold ARDY awards, too. From what we hear, they're going great guns at The Canyons. We do understand that the gang there would sure like to have a newer video to send home with new owners, though (and so would everyone else selling Westgate properties). They feel that the one they've got presents the company in a poor light that does nothing to help with the rescission problem. Can it be true that this video is about a dozen years old? Really? Surely you jest. David Seigel is a business-savvy man and he cannot possibly be so shortsighted as to have such an outdated video to present to new owners. We don't believe it. It simply does not compute. Tell us it isn't so...

Since that time I have gotten used to being the step child resort of Westgate. Everything is Florida, Florida, Florida, even the Westgator (you may check it out the web site) states " On your next visit to Westgate Resorts, come and see some of the new attractions at Walt Disney World Resort!" ......excuse me but my next trip to Westgate Resorts is in the Smoky Mountains (a little too far to go to Disney for the day!).

  • What will happen to Doral Vacation Ownership since the purchase of Meristar by Felcor?
  • Will MPTV make an attempt to buy Silverleaf Resorts, or has Berkley Group already signed the deal? Or????
  • What company is number one in sales volume in the timeshare industry?
    • COMMENT from you: --" As far as top sales volume by company it would have to be Fairfield or Marriott or Trendwest, wouldn't it? If you were measuring sales volume per resort Westgate is by far the leader with annual sales just behind the above mentioned, however this coming from sales at only five properties." Sounds reasonable to us. If you lump fractional sales into the mix, then everything changes, though. What do YOU think?

We'd also like to know, and so would many of our readers, about other minorities in positions from sales manager on up to the top. Any African Americans in positions of authority in the TS biz? Hispanics? etc.

We are told by an attorney that one of the most important things you can do to protect yourself in any situation regarding employment is to KEEP VERY GOOD RECORDS!!!!! Otherwise, you will be at the mercy of the record keeping of the company you may be going up against. Not a good scenario. Can you successfully sue for owed commissions and other matters? Yes, but it depends...

Getting BIGGER
  • A couple of miles outside of Scottsdale, Arizona, you'll find the master-planned community of Desert Ridge springing up from the ground. Marriott's resort there, which is just north of the developing Desert Ridge Marketplace, will have 1,000 rooms and another 500 timeshare condominiums when it is finished. It will be the largest resort in the western US- outside of Las Vegas- when it opens in late 2002. Has the project director already been picked for this project, and are they preparing to commmence sales?
  • The highly regarded firm Roel Construction is building the fourth phase of Four Seasons' Aviara Resort Club and plans to be finished by summer. This is a $19.5 million, 113,000-sf project, which will consist of a 23,000-sf administration building and seven three-story timeshare villa buildings totaling 90,000 sf. Newport Beach-based Wimberly Allison Tong & Goo is the project architect for the timeshare buildings. Who is responsible for the success of this project? Kudos are needed.
  • Marriott has announced its newest vacation ownership resort in Denia, Spain. Check out the press release here.
Getting smaller...
  • Tri-National has sold a bunch of its Baja California, Mexico property to Senior Care Industries, including their 16-acre timeshare site next to the Bajamar Golf Course. (Senior Care Industries Completes $70 Million Transaction) Exactly who is Senior Care Industries anyhow, who will finally do the timeshare component of this project, and what will Tri-National's future part in all of this be?

IN EUROPE and BEYOND:   
Timeshare trials and tribulations, literally, have been in all the headlines overseas this past week. In the UK, the trial of John Palmer and Christina Ketley finally came to a close. The pair were found guilty of massive fraud, and Palmer was sentenced to 8 years. The verdict of guilty and the long sentence seem to have temporarily wiped Palmer's cockiness clean out of him. Ketley's sentence is still pending. Perhaps the biggest victim of this affair is the 10-year old son of the pair.

Palmer's downfall was triggered by his boast to undercover television reporters from the Cook Report posing as Burmese heroin dealers that he could launder 60million pounds sterling for them. The ensuing seven-year investigation uncovered the timeshare scam and brought to an end what detectives have called Palmer's " Teflon crime career" in which they could never make charges stick to him.

Shortly after the famous Brink's-Mat robbery in 1983 police raided Palmer's mansion near Bath and found that part of the haul had been melted down in his furnace in the garden. Palmer fled to the Canary Islands, where he began his timeshare business. He returned to Britain in 1988 to face trial for handling the bullion, but to the dismay of the police he was cleared by the jury after claiming he was ignorant of the origins of the gold.

Palmer later paid £ 360,000 to Lloyd's in an out of court settlement after the insurance company's loss adjusters examined his bank accounts in the UK, Tenerife and the Isle of Man and threatened to take civil action to recover money made from the theft of the Brink's-Mat gold. After his acquittal, Palmer was free to return to his booming timeshare empire.

Palmer had several hundred sales staff working at 11 different timeshare resorts, at least three of which he owned. What he liked to call the " dream team" started to break up in 1996 when his right-hand-man, Brenadan Hannon, fled amid death threats and a firebomb attack on his luxury villa after he fell out with Palmer. He was traced to Morocco, where he was arrested in 1998. Hannon, jailed for four years and four months last September, finally then admitted conspiring with Palmer.

Palmer, Ketley and five other timeshare executives were brought to trial at the Old Bailey on 22 September 1999. But after eight months Palmer, who was defending himself, successfully argued that publicity linking him to a notorious criminal, had prejudiced his case. A retrial was ordered. The retrial doesn't seem to have done him any good, and it certainly cost the British taxpayers a ton of money, but perhaps this-- and the ongoing trial in France of a pair of Scottish brothers for timeshare fraud-- will begin to discourage the rampant fraud that has been rife on the Continent.

Time will tell. Eight years of it, in fact-- for Palmer.
